Welcome to EduGyani ("EduGyani," "we," "us," or "our"), operated by EduGyani Institute & Home Tutors. These Terms and Conditions ("Terms") govern your access to and use of our website www.edugyani.in (the "Site") and our services, including 1-on-1 home tuition, study materials, and school/institute tutor placements (collectively, the "Services").

By accessing our Site, registering an account, booking a tutor, purchasing study materials, or otherwise using our Services, you ("you," "User," "Student/Parent," or "Client") agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Definitions

  • "Tutor" means any individual engaged by EduGyani, or introduced through EduGyani, to provide teaching or tutoring services.
  • "Client" means the student, or the parent/guardian of a student, who books or receives our Services.
  • "Institute" means any school, coaching centre, or educational institution that engages EduGyani for tutor hiring or staffing services.
  • "Study Materials" means notes, booklets, question banks, test series, or other educational content sold or provided by EduGyani, in physical or digital form.

2. Our Services

EduGyani provides:

  1. Home Tuition — in-person, one-on-one tutoring at the Client's residence.
  2. Personalized Home Sessions — tailored 1-on-1 home demo and teaching sessions at your doorstep.
  3. Study Materials — CBSE-focused (and other board) notes, booklets, and test series available for purchase.
  4. School and Institute Hiring — supply or placement of qualified tutors/faculty to partner schools, coaching institutes, and educational organisations on a contractual or engagement basis.

EduGyani reserves the right to modify, suspend, or discontinue any part of its Services at any time, with or without notice, without liability to you.

3. Registration and Eligibility

  • You must provide accurate, current, and complete information when registering or making an enquiry.
  • Services are intended for use by parents/guardians on behalf of minor students, or by adult learners directly.
  • EduGyani reserves the right to refuse, cancel, or discontinue Services at its discretion — for example, where a Tutor is unavailable, a request cannot be reasonably fulfilled, or these Terms have been breached.

4. Fees and Payment

  • Fees for 1-on-1 home tuition and study materials will be communicated to you before the commencement of Services or dispatch of materials.
  • Payment Modes: EduGyani accepts payment through both online modes (UPI, bank transfer, payment gateway, etc.) and offline modes (cash, cheque) as mutually agreed.
  • Full payment (or the agreed instalment) must be made in advance of the start of a course, term, or batch, unless otherwise agreed in writing.
  • EduGyani reserves the right to suspend a Tutor's sessions or withhold Study Materials/access if payment is not received by the due date.
  • Fees, once communicated, may be revised for future terms/batches, but changes will not apply retroactively to fees already paid.

5. Cancellation and Refund Policy

  • Trial/Demo Sessions: Where a free demo class is offered, no payment obligation arises unless you choose to enrol thereafter.
  • Cancellation by Client: Written notice (email/WhatsApp) of at least 7 days is required to cancel or discontinue an ongoing course. Fees paid for sessions already delivered are non-refundable.
  • Rescheduling: Requests to reschedule a session require at least 24 hours' notice; sessions missed without notice may be treated as delivered and are non-refundable.
  • Cancellation by EduGyani: If EduGyani or the assigned Tutor is unable to deliver a scheduled session, a make-up session will be offered, or the fee for that session will be credited/refunded at EduGyani's discretion.
  • Study Materials: Once dispatched (physical) or accessed/downloaded (digital), Study Material purchases are non-refundable, except where the material is found to be defective or incorrect.

6. Home Tuition Sessions — Conduct

  • Clients must ensure a safe, respectful, and appropriate environment for in-person home tuition sessions.
  • Tutors are expected to arrive on time, dress professionally, and maintain high standards of teaching and conduct.

7. School and Institute Hiring

  • Where EduGyani supplies or places Tutors/faculty with a school, coaching centre, or Institute, the specific scope of work, duration, fees, and responsibilities will be set out in a separate written agreement or work order between EduGyani and the Institute.
  • These Terms apply to such engagements to the extent not superseded by the specific written agreement.
  • Institutes are responsible for providing a safe working environment and complying with applicable labour and educational regulations concerning placed Tutors.
  • EduGyani takes reasonable care in selecting and verifying Tutors but does not guarantee particular academic or performance outcomes.

8. Study Materials — Intellectual Property

  • All Study Materials, course content, logos, and website content are the intellectual property of EduGyani (or its content partners) and are protected under applicable copyright and trademark laws.
  • Study Materials are licensed for the personal, non-commercial use of the purchasing Client/student only.
  • You may not copy, reproduce, resell, distribute, or publicly share Study Materials, in whole or in part, without EduGyani's prior written consent.
  • Unauthorised reproduction or distribution may result in termination of access and legal action.

9. Tutor Relationship Disclaimer

  • EduGyani takes reasonable steps to verify the qualifications and background of its Tutors; however, EduGyani does not independently verify every credential or document submitted by a Tutor and is not liable for any inaccuracy, misrepresentation, or forged documentation provided by a Tutor.
  • Tutors engaged through EduGyani are not authorised to bind EduGyani to any representation, promise, or agreement outside the scope of these Terms.

10. Limitation of Liability

  • EduGyani's Services (including 1-on-1 home tuition and Tutor placements) are provided on a reasonable-effort basis. We do not guarantee specific academic results, grades, or exam outcomes.
  • To the maximum extent permitted by law, EduGyani's total liability for any claim arising from the Services shall not exceed the fees paid by you for the relevant course, term, or Study Material giving rise to the claim.
  • EduGyani is not liable for indirect, incidental, or consequential loss, or for disruptions caused by internet outages, technical failures, or events beyond our reasonable control (force majeure).
  • Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by EduGyani's negligence.

11. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information, including information collected for home tuition scheduling, payment processing, and Tutor matching.

12. Termination

EduGyani may suspend or terminate your access to Services, without notice, if you breach these Terms, provide false information, or engage in conduct that is abusive, unsafe, or unlawful. You may discontinue Services at any time subject to the cancellation terms in Section 5.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts at Delhi, India.

14. Changes to These Terms

EduGyani may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
